As an owner of property, including buildings as well as agricultural and forestry businesses, you are legally required to pay a land tax on your property – a tax levied by the state from which the cities and municipalities benefit and which serves as an important funding tool, for example for constructing schools, daycare centers, swimming pools, roads, bicycle paths, or bridges. In 2018, the Federal Constitutional Court had declared the previously valid system of evaluating property for tax purposes as unconstitutional and decided that new legal regulations were needed. The reason for this: recent unequal tax treatment in relation to the rateable value for property in West and East Germany. As of January 1, 2022, the assessment was to take place in line with the new regulations, although the federal states benefit from a transition period until December 31, 2024. Starting on January 1, 2025, the previous law will become void and the new property tax regulations will become binding.

To be able to reassess all properties and resort to a substantiated foundation for measuring property tax, property and real estate owners need to get involved. That’s why they need to submit an assessment return between July 1, 2022 and October 31, 2022.
